    Well, they say it's WordPress. That claim is either false or they're in violation of the GPL, under which WordPress is distributed. Any derivative work under the GPL has to be distributed under the GPL as well and therefore cannot be sold.

    And of all the themes I designed, at least they had the decency to use my personal least favorite. I'd hate that they used the one I love most.

    But **is** there any law against them profiting from WordPress in this way?

    For example, I am soon launching a pet-theme WPMU community. It is housed on my server space, for which I pay. In order to host such a community of blogs, is it inherently wrong to charge for at least the space each blog will be occupying? Or since WP/WPMU are free, any permutation of them must remain so? (I don't plan to charge anyone at my WPMU site, this was just a theoretical question.)

    I wouldn't think there would be a problem but I would offer a free option with less space / fewer features, etc.
