Nevermind, I tried deleting it and it allowed me. Then I just reuploaded the new file.
For reference in case someone searches for this, some CPanel settings won't allow you to delete the htaccess file. Your best bet would be to chmod it to 666 for editing.
.. just use a ftp program instead of the ftp interface of CPanel, because the web interface is not always having the proper roles...
