I Build one template, that is similar with the wordpress.com(80%)
What is a problem with copyright or not?

Can't you think of something on your own? Maybe use something from http://themes.wordpress.net/ instead?

Before there, I haven't knew svn template directory. I already known the themes.wordpress.net.
Thank everyone! But I still use the wordpress.com template with they copyright in my page footer. :D -

Which means you would still be violating their copyright.
Which part of this is confusing?
If you want a nice theme for your site, download one, write one, or contract one out.
